Coverage: Devon.The Devon Waste Plan was adopted by Devon County Council on 11th December 2014, with the provision for the protection of waste management capacity through Policy W10 and the identification of Wasted Consultation Zones as outlined in Appendix C of the Plan.The main features of the WCZs are that they will:be identified for a defined range of waste management facilities, tacking account of the need to limit the administrative burden on County and District Councils;include a ‘buffer area’ beyond the site boundary, dependent on the type of facility, to ensure appropriate consideration of relationships with sensitive receptors;be updated annually through the County Council’s Monitoring Report to ensure that new facilities are protected and closed facilities are omitted.Appendix C advices that district/city/borough councils should consult Devon County Council in its role as the waste planning authority on planning applications for development within a WCZ, and to take account of any potential constraints on that waste site. This approach reflects the requirement of paragraph 8 of the Government’s National Planning Policy for Waste for local planning authorities to ensure that;“the likely impact of proposed, non-waste related development on existing waste management facilities, and on sites and areas allocated for waste management, is acceptable and does not prejudice the implementation of the waste hierarchy and/or the efficient operation of such facilities”.To avoid excessive requirements for consultation, Appendix C of the Devon Waste Plan includes a list of categories of planning application within a WCZ that do not require consultation with the County Council, including for sites allocated in an adopted Local Plan.
